What type of business will ensure that it will meet the E-2 criteria listed above?
The typical business for an E-2 visa is one that buys goods and services from other suppliers and employs full time staff and in turn produces its own goods and services. For example, a restaurant has an economic impact on the community by buying raw products from its suppliers and converting them into cooked meals. On the other hand, a rental property does not buy any goods or services other than to hire someone to do occasional yard maintenance or home repairs. The economic impact is very marginal and no full time employment is created by such a business.
How can I be sure that I select a business that will guarantee a five-year E-2 visa?
The length of the visa is determined by the visa officer using the various factors cited above. A marginal business will usually result in a two-year visa whereas a strong business will most likely yield a five-year E-2 visa. Nowadays the Embassy is issuing two year E-2 visas as opposed to 5 year, and in some cases when your business has several employees it may be granted a 5 year extension as opposed to a 2 year extension.
